SHORT TERM HOLIDAY RENTAL

1.1 Reservations are accepted by Pru Cameron at PO Box 5626 CANNING VALE SOUTH WA 6155 as owner/manager for Busselton Holiday Home (BHH).

1.2 The property is offered for holiday purposes only, for a maximum 90 consecutive nights.

1.3 Commercial functions and/or parties of any type are prohibited and failure to comply shall be considered a breach of these terms and conditions. This includes 'schoolies' week. We do not accept leavers under any circumstances.

1.4 This accommodation contract is between the guest and the owner of the property for which the booking is made and is subject to the terms and conditions herein and is offered only for the period stated on the invoice.

1.5 There is a minimum stay of three nights for peak periods, being all WA school holidays. Gazetted WA long weekends and local special events, including Busselton Iron Man and Leeuwin Estate concerts have a minimum stay of three nights, and are also peak period rated. Christmas Holidays have a minimum stay of five nights. We do accept single night bookings with a surcharge of $100.

1.6 Guests must notify BHH of expected arrival time and a mobile contact number (for the duration of the stay) at time of booking. Arrival is after 2pm and departure prior to 10am.

1.7 PIN for key access will be advised direct to the guest between noon and 2pm on the day of arrival via text message. There is a locked box at the poperty containing the key. This is wall mounted around the left hand side of the property adjacent to the meter box. This is where one set of keys needs to be returned to on your departure. The second set of keys needs to be left inside the house from where they were collected from.

DEPOSIT / PAYMENTS

2.1 Bookings are subject to availability .The accommodation contract shall not be effective until such time as the property owner provides the guest with written confirmation of the booking. A booking confirmation, invoice and a copy of these terms and conditions of hire will be emailed.

2.2 All payments to be in Australian dollars, we accept payment by direct deposit; bank cheque; money order or credit card (MasterCard and Visa only). Personal cheques accepted if received and cleared 30 days prior to arrival.

2.3 Where payment is made by credit card, a credit card surcharge fee of 2.9% will apply. Payments made via EFT incur no surcharge.

2.4 Once availability is confirmed and your deposit has been paid, an invoice will be issued. The invoice will include all tariffs for the stay, including a cleaning fee of $250 and $500 bond.

2.5 Payment of the deposit of 50% of the tariff constitutes acceptance of these Terms and Conditions.

2.6 The balance payable is to be paid a minimum thirty (30) days prior to arrival.

2.7 Where a booking is made less than 30 days prior to arrival, full payment is required at time of booking including $1,000 bond.

2.8 A tentative booking will be held for 24 hours only, after which time the booking will lapse unless the deposit has been paid.

2.9 Where payment is made by credit card, the credit card must belong to the guest making the booking. This guest must also be present on the holiday and will be considered the responsible person.

2.10 We recommend all guests purchase travel insurance since BHH are not responsible for any injuries, illness or accidents that may occur whilst staying at the property.

2.11 A late departure fee of $50 will be withheld from the bond where departure is later than the agreed time.

SECURITY BOND

3.1 The bond will be returned to the guest in the same manner in which the booking was originally paid for.

3.2 Within seven (7) days, subject to cleaners vacate report.

CANCELLATION PENALTIES

4.1 Cancellations will incur the following penalties... • 7 days prior to arrival - 80% of the tariff • 14 days prior to arrival - 60% of the tariff • 21 days prior to arrival - 40% of the tariff • 30 days prior to arrival - 20% of the tariff

4.2 A variation which reduces the number of nights will be treated as a cancellation in respect to those nights.

4.3 A cancellation more than 30 days prior to your arrival will incur an administration fee of $50.

NUMBER OF GUESTS / VISITORS

5.1 Number of guests on the property at any one time must not exceed 10 people (as per license conditions). Guests on premises in excess of 10 will result in a request for your immediate departure from the property, with no return of unused tariff.

5.2 The number of guests staying overnight must not exceed the number indicated at the time of original booking.

5.3 Ages of children must be disclosed at time of original booking. Fixed safety gates are located at the top and bottom of the stairs. Travel cot and high chair available on request and must be indicated at time of booking.

LINEN / FURNITURE

6.1 The property is fully furnished and self contained, including all linen. Each guest will have two bath towels. All linen must remain on the property at all times, and bath towels are absolutely not to be taken to the beach. Beds will be made up prior to arrival, and used beds must be stripped on departure, and used linen is to be placed in the laundry.

6.2 Furniture and fittings must not be moved and are to remain as they were at the commencement of the occupancy.

PARKING

7.1 Registration numbers of vehicles that will be parked at the property must be advised at time of original booking.

7.2 A maximum of four (4) cars can be parked at the premises at any one time, two in the garage and two in the driveway. Any oil stains will incur additional cleaning fees. 7.3 Guests and visitors must comply with parking regulations and show consideration to neighbours.

NO SMOKING

8.1 The property is STRICTLY NON SMOKING. Guests and any additional invitees must not smoke inside the premises and this will be strictly adhered to. Failure to comply will be considered a breach of these terms and conditions and the guest will be liable for any additional charges to remove smoke contamination to fabrics and curtains.

8.2 Please dispose of cigarette butts thoughtfully if smoking outside. Removal of cigarette butts not disposed of properly will incur additional cleaning fees.

BINS / RECYCYLING

9.1 It is the guest’s responsibility to ensure the property bin(s) is left out for collection every Tuesday evening for collection early Wednesday morning.

9.2 Recycling bins are emptied fortnightly on the same day as the regular refuse collection. Please refer to the calendar in the compendium for the correct fortnight to leave the bin out.

9.3 No cleaning of fish on the property. All fish cleaning waste is to be disposed of at the site of cleaning.

9.4 Excessive rubbish (ie more than what will fit in the bin with allowing the lid to close completely) is the responsibility of the guest and must be taken with you upon departure. Surcharges may apply for excess rubbish left behind.

BBQ

10.1 There is a gas BBQ at the property with gas bottles. In the event that you use excessive gas you will need to take the bottle to Bunnings and do an exchange. There should be adequate gas there for the duration of your stay.

10.2 Please leave the BBQ in the same clean condition as you find it in. Failure to do so will result in a BBQ cleaning fee of $150.

PETS

11.1 Absolutely no pets allowed on the property at any time. If evidence of a pet is found or reported to BHH it is considered a breach of these terms and conditions and the guest will be liable for additional cleaning costs.

INJURY / LOSS

12.1 BHH will not be liable to any guest or invitee for any loss or damage suffered by the guest or invitee whether to person or property arising in any way out of the occupancy unless such loss or damage is a direct result of a deliberate act or the negligence of BHH.

12.2 Lost keys will be charged for. Guests are responsible for cost of replacement of any keys, garage door remotes, etc. This will be deducted from bond. Garage Door buzzer replacement charge is $150. Lost keys will be charged at $500 as this will mean the whole house will be rekeyed.

12.3 Major breakages that affect the tenancy need to be reported by phone to the manager on 0405 102 706 immediately. Any general breakages must be reported to the cleaner via a note left on the kitchen bench adjacent to the keys.

12.4 Busselton Holiday Home reserves the right to charge guests the cost of rectifying damage, caused by the deliberate, negligent or reckless act of the guest to the property and furnishings, and to replace with new any missing items. If the damage to the property is such that the property cannot be let again until rectified, then that loss of income will also be billed to the guest.

12.5 BHH accepts no responsibility for any inconvenience due to breakdown of any appliance or failure to supply. However, all efforts will be made to replace or repair any faults in a timely manner. Where immediate repairs are not possible ie. waiting on trades/parts, no responsibility is accepted by BHH. Guests reporting a service call which is subsequently found not to be required will be responsible for any trade fees charged.

12.6 Wireless internet is provided as a convenience and no compensation for loss of connection or speed issues will be offered. Access code is available on site.

DISTURBANCE AND ANTI-SOCIAL BEHAVIOUR

13.1 Busselton Police (08) 9754 9555 or Dunsborough Police (08) 9781 3000.

13.2 Excessive noise and anti-social behaviour will not be tolerated. Guests and their invitees must behave in a manner that will not cause offence, embarrassment or disturbance to the occupier of another lot or neighbour of the property. Failure to comply will constitute a breach of these terms and conditions and result in the immediate termination of the booking, with no reimbursement for unused tariffs.

13.3 Guests are responsible for all visitors and must ensure their visitors comply with all house rules.

13.4 If security is called, the guest will be liable for any charges associated with the call out.

13.5 Complaints resulting in attendance by the police will be viewed as a serious breach of these terms and conditions and BHH reserve the right to issue a reminder warning with regard the terms and conditions and / or terminate your booking.

13.6 Noise is to be kept to a reasonable level especially during the hours of 10pm and 8am.

COMPLAINTS AND DISPUTE PROCEDURE

14.1 Any disputes or complaints arising during or from the occupancy are to be directed to the manager by phone in the first instance, and to be followed up in writing to the manager within 2 days of departure from the property.

GENERAL CONDUCT

15.1 Whenever the guest departs the property during the occupancy, they must ensure all doors and windows are securely locked, and all lighting and electrical appliances are switched off.

15.2 It is expected that dishes will be washed and put away, dishwasher emptied, and major cooking mess, including the BBQ and oven, will be cleaned prior to departure, beds will be stripped and used linen placed in the laundry. Any additional cleaning will be charged to the guest at cleaners hourly rate.

15.3 BHH does not accept liability for any injury, damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by force majeure or other events beyond our control or not preventable by reasonable diligence by our part including but not limited to war, civil disturbance, fire, floods, unusually severe weather, acts of God, acts of Government or any other authorities.

DEPARTURE CHECKLIST

    When vacating the property at the end of your occupancy, please ensure that you attend to the following:

  • Strip the beds you have used and place used linen in the laundry
  • Empty inside bins and take all rubbish to the outside bins.
  • Do dishes and leave the kitchen as you found it.
  • Clean BBQ.
  • Turn off all lights (be sure to leave the front sensor light on).
  • Turn off the airconditioner.
  • Close and lock all doors and windows. Failure to comply with vacating instructions will result in additional charges.

FAILURE TO COMPLY WITH TERMS AND CONDITIONS

16.1 Failure to comply with these Terms and Conditions may result in charges against any security deposit.

16.2 We reserve the right to amend these Terms and Conditions without notice. 16.3 The guest agrees that should they or any of their invitees commit any breach of these terms and conditions, then BHH may terminate the occupancy created by this agreement immediately and without prior notice and the guest shall vacate the property and remove all their personal property forthwith. Should this action be taken there will be no return of unused tariff.
